OPERATIONS AND SERVICES TERMS & CONDITIONS

Welcome to the website of ClimateCare Services, LLC (“ClimateCare,” “we,” “us,” or “our”). These Terms & Conditions govern your access to and use of the ClimateCare Services website, including information, forms, scheduling tools, estimate requests, communications, and other features made available through the website.

By accessing or using this website, you acknowledge these Terms & Conditions. If you do not agree with them, please discontinue use of the website.

1. About ClimateCare Services

ClimateCare Services provides residential and commercial HVAC, plumbing, indoor air quality, maintenance, repair, replacement, installation, new construction, and related comfort services.

Information regarding our services, manufacturers, equipment, promotions, financing, service areas, and other offerings is provided for general informational purposes and may change from time to time.

2. Website Use

You agree to use this website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the website, servers, accounts, networks, or systems;
  • Interfere with the security, functionality, or operation of the website;
  • Introduce viruses, malicious code, automated attacks, or other harmful materials;
  • Submit fraudulent, false, misleading, or unlawful requests or information;
  • Impersonate another person or misrepresent your identity or authority;
  • Scrape, reproduce, copy, distribute, or commercially exploit website content without authorization; or

Website content, including information regarding HVAC systems, plumbing systems, equipment, energy efficiency, troubleshooting, maintenance, repair-versus-replacement decisions, equipment sizing, indoor air quality, rebates, warranties, and similar topics, is not a substitute for an on-site inspection, professional diagnosis, system design, engineering analysis, formal estimate, or written service agreement.

Every property and mechanical system is different. ClimateCare Services cannot determine or guarantee the cause of a problem, appropriate equipment selection, system capacity, required repairs, code compliance, installation requirements, project cost, safety condition, or recommended solution solely from website information, photographs, electronic communications, or information submitted through an online form.

Where appropriate, recommendations will be based on an evaluation of the specific property, system, equipment, and conditions involved.

4. Estimate and Service Requests

Submitting a contact form, requesting an estimate, requesting service, scheduling an appointment, communicating with ClimateCare Services, or providing information through this website does not, by itself, create a binding service agreement or require ClimateCare Services to perform work.

Unless expressly stated otherwise in writing:

  • Website descriptions and promotional information are not binding offers;
  • Estimates are based on the information and conditions reasonably known at the time they are prepared;
  • Pricing may change when concealed conditions, additional repairs, labor, materials, equipment, permits, code requirements, access conditions, or other circumstances are discovered;
  • Equipment and materials are subject to availability;
  • Scheduling is subject to technician availability, weather, equipment availability, permitting, site conditions, emergencies, and other circumstances; and
  • ClimateCare Services reserves the right to decline work or determine that additional evaluation is required before providing an estimate or performing services.

 

Any actual service, repair, maintenance, replacement, installation, construction project, or other work performed by ClimateCare Services will be governed by the applicable estimate, proposal, work authorization, work order, invoice, maintenance agreement, financing agreement, construction agreement, or other written agreement associated with that work.

If a separately accepted written agreement conflicts with these Terms & Conditions, the separately accepted agreement will control with respect to that specific project or service.

5. Customer Information and Authorization

When submitting an estimate request, service request, appointment request, or other inquiry, you agree to provide information that is accurate and complete to the best of your knowledge.

By requesting services for a property, you represent that you are the property owner or otherwise have sufficient authority to request an inspection, estimate, service, repair, maintenance, or installation at the property.

ClimateCare Services may rely upon information you provide when evaluating your request.

6. Appointments and Property Access

Customers are responsible for providing safe and reasonable access to the property, equipment, utilities, mechanical rooms, electrical panels, plumbing systems, crawl spaces, attics, roofs, and other work areas reasonably necessary to evaluate or perform requested services.

Customers should disclose known unsafe conditions, access restrictions, hazardous materials, or other circumstances that may affect ClimateCare Services personnel before an appointment.

Appointments may be delayed or rescheduled because of emergencies, severe weather, technician availability, equipment or material availability, unsafe conditions, permitting, supplier delays, or circumstances beyond ClimateCare Services’ reasonable control.

Any applicable diagnostic, dispatch, trip, cancellation, after-hours, or service-call fees will be communicated through the applicable appointment confirmation, estimate, work order, invoice, or service agreement.

7. Existing and Concealed Conditions

HVAC, plumbing, electrical, structural, building-envelope, and other property conditions may not be fully visible or identifiable before work begins.

ClimateCare Services is not responsible for pre-existing defects or conditions that were not caused by ClimateCare Services, including concealed damage, deteriorated equipment, existing code deficiencies, mold, asbestos, corrosion, deteriorated ductwork or piping, hidden leaks, previous water damage, structural deficiencies, electrical problems, or other concealed conditions.

If previously unknown conditions are discovered, additional evaluation, work, materials, equipment, permits, or pricing may be required and will be addressed through the applicable service or project agreement.

8. Emergency Situations

Website forms, email, social media, and other online communications should not be relied upon for immediate emergency assistance. Electronic submissions may not be monitored continuously or reviewed immediately.

If you smell natural gas, suspect carbon monoxide, observe fire or smoke, experience a major water leak or flooding condition, encounter a serious electrical hazard, or believe a condition presents an immediate threat to life or property, contact the appropriate emergency authority or utility provider and leave the affected area when appropriate.

Call 911 when emergency assistance is required.

ClimateCare Services may be contacted by telephone for HVAC or plumbing service once it is safe and appropriate to do so.

Do not rely exclusively on this website for emergency assistance.

9. Photographs, Documents, and Uploaded Materials

The website may allow you to submit photographs, equipment information, documents, plans, specifications, equipment labels, or other materials.

By submitting materials, you represent that you have the right and authority to provide them.

You authorize ClimateCare Services and service providers acting on our behalf to access, store, reproduce, transmit, and use submitted materials as reasonably necessary to:

  • Evaluate your request;
  • Identify equipment or conditions;
  • Prepare an estimate or proposal;
  • Schedule or provide services;
  • Maintain service and warranty records;
  • Provide quality assurance;
  • Communicate with you; and
  • Maintain appropriate business records.

 

Providing photographs or other materials does not guarantee that ClimateCare Services can diagnose a condition, select equipment, determine system sizing, establish pricing, or provide a final recommendation without an on-site evaluation.

10. Financing, Rebates, Tax Incentives, and Third-Party Programs

The website may contain information or links concerning financing programs, manufacturer promotions, rebates, utility incentives, tax credits, tax incentives, warranties, or other programs administered by third parties.

Eligibility, availability, approval, rates, terms, deadlines, documentation requirements, and payment of incentives are determined by the applicable third-party provider or governmental authority.

Unless specifically stated in a written agreement, ClimateCare Services does not guarantee:

  • Financing approval;
  • Interest rates or financing terms;
  • Manufacturer incentives;
  • Utility rebates;
  • Tax credits or tax treatment;
  • Rebate or incentive eligibility;
  • Processing or payment timelines; or
  • Continued availability of any third-party program.

 

Customers should consult the applicable provider and, where appropriate, their tax or financial adviser regarding eligibility.

11. Manufacturer and Product Information

ClimateCare Services may reference or display manufacturers, equipment models, trademarks, product descriptions, efficiency ratings, technical specifications, warranties, or other product information.

Product specifications, equipment availability, manufacturer programs, efficiency ratings, warranty terms, and model offerings may change without notice.

Manufacturer names, logos, trademarks, and product names are the property of their respective owners. Reference to a manufacturer or product does not imply ownership by ClimateCare Services of that manufacturer’s intellectual property.

12. Warranties

Any warranty applicable to equipment, materials, installation, repair, replacement, or maintenance services will be governed by the applicable estimate, proposal, invoice, work order, manufacturer warranty, maintenance agreement, or other written service agreement.

Statements appearing on this website do not create additional warranties unless expressly incorporated into a written agreement with ClimateCare Services.

Manufacturer warranties remain subject to the manufacturer’s applicable terms, exclusions, registration requirements, procedures, and limitations.

To the fullest extent permitted by law, ClimateCare Services disclaims warranties relating solely to the operation or use of this website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms & Conditions is intended to exclude warranties or consumer rights that cannot lawfully be waived or limited.

17. Electronic Communications, Fraud & Cybersecurity

ClimateCare Services may communicate with customers and prospective customers electronically, including by email, text message, electronic estimates, proposals, invoices, payment links, scheduling notifications, and other digital communications.

Customers should be aware that email, text messaging, websites, and other electronic communications may be subject to phishing, spoofing, malware, viruses, unauthorized access, account compromise, fraudulent impersonation, or other cybercriminal activity by third parties.

Payment and Banking Instructions

ClimateCare Services will not expect a customer to rely solely upon an unexpected email or text message requesting a material change to previously established:

  • Banking information;
  • Wire-transfer instructions;
  • ACH instructions;
  • Payment recipient;
  • Payment destination; or
  • Method of payment.

 

Before acting upon any unusual or unexpected payment instruction, change in banking information, wire-transfer request, ACH request, or request to redirect payment, customers should independently verify the instruction by calling ClimateCare Services at a known and previously verified telephone number.

Customers should not rely solely upon telephone numbers, email addresses, links, attachments, or other contact information contained within a suspicious or unexpected communication when attempting to verify its authenticity.

Suspicious Communications

Customers should contact ClimateCare Services before taking action if they receive a communication appearing to originate from ClimateCare Services that:

  • Requests an unexpected change in payment or banking information;
  • Requests payment to a new or unfamiliar account;
  • Requests an unusual form of payment;
  • Contains unfamiliar links or attachments;
  • Requests passwords, account credentials, or other sensitive information;
  • Appears inconsistent with previous communications; or
  • Otherwise appears suspicious or potentially fraudulent.

 

ClimateCare Services may also contact a customer to verify unusual transactions, payment requests, account changes, or other communications when appropriate.

Third-Party Cybercriminal Activity

To the fullest extent permitted by applicable law, ClimateCare Services is not responsible for losses or damages resulting from fraudulent communications, phishing, spoofed emails or websites, malware, viruses, unauthorized third-party access, compromised customer or third-party systems, fraudulent impersonation, or other cybercriminal activity that is outside ClimateCare Services’ reasonable control.

Customers are responsible for maintaining reasonable security over their own email accounts, computer systems, mobile devices, passwords, networks, and financial accounts.

Nothing in this Section excludes or limits liability that cannot legally be excluded or limited under applicable law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ClimateCare Services and its owners, employees, contractors, and representatives from claims, liabilities, damages, and reasonable expenses resulting from:

  • Your unlawful or unauthorized use of the website;
  • Your violation of these Terms & Conditions;
  • Your infringement of another party’s rights; or
  • Materials or information you submit without having the legal right or authority to provide them.

To the extent permitted by applicable law, any dispute specifically relating to use of this website or these Terms & Conditions shall be brought in a court of competent jurisdiction serving Anne Arundel County, Maryland, unless a separately executed agreement or applicable law requires otherwise.

21. Severability

If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.

Any invalid or unenforceable provision will be limited or modified only to the extent necessary to make it enforceable where permitted by law.

ClimateCare Services may revise these Terms & Conditions periodically to reflect changes in our website, services, technology, business practices, or legal requirements.

The current version will be posted on this page with an updated effective date.

Continued use of the website after revised Terms & Conditions are posted constitutes acceptance of the revised terms to the extent permitted by applicable law.
